User’s Acknowledgement and Acceptance of Terms and Conditions

Dane C. Olevian Numismatic Rarities (“Olevian Numismatic Rarities” or “ONR” or “we” or “us” or “our”) provides the website www.ONRcoins.com (the “Website” or "Site") and other services, including services offered on the Website and services not directly available from the Website, subject to Your compliance with and Your agreement to all the terms, conditions, and notices contained or referenced herein (the “User Agreement” or “Terms and Conditions”), as well as any other written or implied agreement between ONR and You or Your company. The terms “You” and “Your” as used herein refer to the visitor to the Website and any person or entity who uses ONR’s services, including any person who purchases product(s) from, or sells product(s) to, ONR. These terms and conditions apply to all orders, purchases, sales, appraisals, and other services whether initiated through the Website, by telephone, in person, or otherwise. In addition, when using particular services or materials on the Website, You shall be subject to any posted guidelines or rules applicable to such services or materials that may contain terms and conditions in addition to those in this User Agreement. All such guidelines or rules are hereby incorporated by reference into this User Agreement.

Before You place any orders to purchase from and/or sell to ONR, You must read and accept all of the terms in this User Agreement. Your use of this Website and/or Your placement of any orders to purchase from and/or sell to ONR, whether through the Website, by telephone, in person, or otherwise, constitutes a representation by You that You have read this User Agreement and agree to be bound by the terms and conditions contained herein.

This User Agreement is effective as of August 1, 2014 for all existing customers and all existing users of this Website, and will be effective upon acceptance, as set forth above, for all new customers and all new users of this Website or ONR’s services. ONR reserves the right to change the terms and conditions of this User Agreement without notice to You. You acknowledge and agree that it is Your responsibility to review the Website and this User Agreement periodically, and to be aware of any modifications. Your continued use of this Website and/or Your continued use of any services provided by ONR after such modifications will constitute Your acknowledgement of the modified User Agreement and Your agreement to abide and be bound by the modified User Agreement.

A. General Terms and Conditions

1. Our Rights

We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice and You confirm that we shall not be liable to You or any third party for any modification to or withdrawal of the Website.

We reserve the right to change this User Agreement from time to time, and Your continued use of the Website (or any part of) following such change shall be deemed to be Your acceptance of such change. It is Your responsibility to check regularly to determine whether the terms and conditions of this User Agreement have been changed. If You do not agree to any change to the User Agreement then You must immediately stop using the Website.

We reserve the right to use our reasonable efforts to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because You cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

1. Your Obligations

You agree not to use the Website (or any part of) for any illegal purpose and agree to use it in accordance with all relevant laws.

You agree not to upload or transmit through the Website any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer.

You will not upload or transmit through the Website any material which is defamatory, offensive, or of an obscene or menacing character, or that may cause annoyance, inconvenience, or needless anxiety.

You will not use the Website in a way that may cause the Website to be interrupted, damaged, rendered less efficient, or such that the effectiveness or functionality of the Website is in any way impaired.

You will not use the Website in any manner which violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality, or rights of privacy).

You agree that in the event that You have any right, claim or action against any Users arising out of that User's use of the Website, then You will pursue such right, claim or action independently of and without recourse to us.

You hereby agree to execute and deliver such other documents and take such other actions as may be reasonably requested by ONR to carry out this User Agreement.

B. Doing Business with ONR

1. Purchase and Investment Risks

Investing involves risks and may not be suitable for everyone. You understand that all coin, paper money, and precious metals purchases and investments involve risk, including partial or total loss of investment capital. You are encouraged to consult personal financial advisors before making any purchase or investment decisions. ONR and its agents are not financial or investment advisors and cannot be held responsible for Your investment decisions, including decisions to purchase rare coins or precious metals that are subsequently subject to market loss and/or reduction in liquidity or resale value. ONR does guarantee that every product that we sell is genuine and that all precious metals products are of the weight and purity advertised in our product description. ONR also provides general information on how to invest in rare coins and precious metals on its website, but makes no recommendations, projections, representations, or guarantees with respect to the future price or performance of any coin or precious metals product that it sells. By purchasing from, making sales to, or ordering from ONR, You acknowledge that You are ultimately making all of Your own decisions and that You are subject to a variety of risks for which ONR is not liable and You are solely responsible. You also acknowledge that You represent and warrant to ONR that You have sufficient experience and knowledge to make informed decisions to purchase from and/or sell to ONR.

2. ONR Online Ordering System

ONR disclaims any liability or responsibility for orders placed through the ONR Website order system, including, but not limited to, any loss or damage, whether direct, indirect, consequential, or incidental, that You or any third-party may suffer or incur as a result of the use of the ONR Website order system, whether such loss or damage is caused by the ONR order system or otherwise. Further, ONR disclaims any liability or responsibility for the interruption, cancellation, or other termination of the ONR online order system.

All orders placed through the ONR Website order system are taken on a best efforts basis. ONR shall not be responsible for errors, negligence, or inability to execute such orders. Further, You understand and agree that the services available on this Website are provided “as is” and that ONR shall not be responsible for any delays in the transmission, delivery, mis-delivery, deletion, or execution of Your orders, due to failure of transmission, or breakdown or failure of communication facilities, or due to any other cause beyond ONR’s reasonable control.

If pricing or typographical errors occur on the website, we reserve the right to cancel any Sales Orders or Purchase Orders associated with that item and will notify You of such cancellation. You expressly waive any right to any claim or actual damages that may occur as a result of an error that leads to order cancellation, refund, and/or shipping delay.

3. Forward Transactions and Confirmation of Transactions

Forward transactions are purchases or sales between You and ONR in which the price is agreed upon prior to delivery and/or payment for the transaction. Any published prices and rates listed on the Website are to be used as indications only and are not guaranteed offers to buy or sell. Buy or sell offers issued by telephone are valid for the duration of the telephone call only. ONR is under no obligation to honor a price quote on a later phone call, but instead will make a new offer commensurate with current market conditions. This new quote may be the same, higher, or lower than previous quotes based on these new conditions. All purchase and sales transactions (Purchase Orders and Sales Orders) must be confirmed over the telephone with a customer service associate or electronically through www.ONRcoins.com to be effective. When an order is confirmed, an order number is generated by ONR and the price for the product(s) included in Your confirmed order is established. ONR shall not be liable for fulfillment of any transaction if an order number and a confirmed price has not been generated and communicated to You. The confirmed Sales Order price is locked-in for 5 business days. You must ensure that Your payment is dated within 24 hours of the time of Your confirmed Sale and received by ONR within 5 Business Days of Your confirmed Sale or Your order may be cancelled and You may be subject to Cancellation and Market Loss fees described below.

4. ONR Cancellation Rights

ONR reserves the right to cancel any Sales Order at any time and for any reason, including, but not limited to, if You default in Your performance of payment or any other act required of You. Prior to payment to You, ONR also reserves the right to cancel any Purchase Order and return any product(s) it purchases from You within ten (10) business days of shipment or delivery to ONR for any reason, including, without limitation, if the product(s) are counterfeit, misrepresented, of inferior quality, or not the items ONR intended to purchase. If ONR chooses to return Your product(s), ONR shall have no liability to You for payment for the product(s) included in Your confirmed Purchase Order. In no circumstance will ONR be liable to You for any losses or damages that may occur to You as a result of our cancellation of Your Sales Order or Purchase Order.

5. Buying from ONR

a. Minimum and Maximum Transaction Values

There is no minimum or maximum Sales Order for any transaction, regardless of payment method. However, ONR reserves the right to request a down payment or deposit on any large order which we deem "significant," prior to confirming the order and locking-in the final sale price. On orders greater than $50,000.00, we recommend calling customer service at 1-844-667-2646 to confirm whether a deposit will be required.

b. Precious Metals Sales

i. Precious Metals Sales Order Adjustments

Sales orders on Precious Metals are final and cannot be adjusted after confirmation. Please choose Your products carefully and review all details before submitting Your order.

ii. Precious Metals Sales Order Cancellations

Cancellation Requests

Once a Sales Order confirmation has been issued, the price is locked-in and You are contractually bound to complete the transaction, or You will pay a Cancellation fee for breaching this contract. A Sales Order can be cancelled before the order is shipped, which is generally no more than 1 business day from the order date. Once a Sales Order has shipped, it cannot be cancelled. All cancellation requests must be made by notifying our customer service by telephone at 1-844-667-2646. If the Sales Order can be cancelled, You will be given a Sales Order Cancellation Number. No Sales order without a Cancellation Number issued will be considered cancelled.

Cancellation and Market Loss Fees

Cancellation of a Sales Order for any product listed under the "Gold," "Silver," "Platinum," and "Palladium" sections of the ONR Website (“Precious Metals”), as well as certain Precious Metals-related products listed under the "Rare Coins" section, including, but not limited to “Pre-1933 Gold Coins,” will be subject to Cancellation fees and Market Loss fees. You will be charged a $50 Cancellation Fee and ONR will have no liability to You for the product(s) included in Your Sales Order. In addition, if the Fair Market Value of the Product(s) at the time of the cancelled Sales Order is less than the original sales price of the Product(s) as it appears on the cancelled Sales Order, as determined by ONR, then a Market Loss is said to occur and You will be liable to ONR for the total Market Loss. You must also pay, and have full responsibility and liability to, ONR for all fees and costs associated with ONR’s efforts to collect from You. You also agree to remit payment in good funds immediately upon ONR’s request for such payment. All pending Sales Orders will be held for shipment and no future orders by You will be permitted until all outstanding Cancellation and Market Loss fee balances have been paid in full.

Cancellation and Market Gains

If the Fair Market Value of the Product(s) at the time of the cancelled Sales Order is greater than the sales price of the Product(s) as it appears on the original Sales Order, as determined by ONR, then a Market Gain is said to occur and such gain will remain the sole property of ONR and ONR shall have no responsibility to You for the Market Gain. The cancellation fee will still apply in the event of a Market Gain.

iii. Precious Metals Sales Order Returns

Return Requests

Once a Sales Order has been shipped, it cannot be cancelled. A Sales Order can be returned, however, within 5 business days of delivery to You. All return requests must be made within 5 business days of receiving Your Sales Order by notifying our customer service by telephone at 1-844-667-2646. If the Sales Order can be returned, You will receive written confirmation of the return, a Return Authorization Number, and instructions on how to return Your items. You must follow all instructions provided by customer service, including carefully packaging the product, and must ship Your return within 1 business day of receiving a return confirmation. You are responsible for the cost of return shipping and assume the risk of loss during the return shipment. ONR reserves the right to reject any return it receives in which our instructions have not been followed. No Sales order without a Return Authorization Number can be returned and ONR will refuse any return shipment received without a Return Authorization Number. After 5 days of receiving Your Sales Order no products can be returned. However, if the products are needed by ONR, ONR may offer to purchase them based on current market conditions, which may be the same, less than, or greater than the price You paid for it.

Return Fees and Market Loss

Return of a Sales Order for any product listed under the "Gold," "Silver," "Platinum," and "Palladium" sections of the ONR Website (“Precious Metals”), as well as certain Precious Metals-related products listed under the "Rare Coins" section, including, but not limited to “Pre-1933 Gold Coins,” may be subject to Restocking fees and Market Loss fees. You may, at ONR’s discretion, be charged a restocking fee equal to $50 or 10% of the original Sales Order, whichever is greater. In addition, if the Fair Market Value of the Product(s) at the time of the Returned Sales Order is less than the original sales price of the Product(s) as it appears on the original Sales Order, as determined by ONR, then a Market Loss is said to occur and You will be liable to ONR for the total Market Loss. You must also pay, and have full responsibility and liability to, ONR for all fees and costs associated with ONR’s efforts to collect from You. You also agree to remit payment in good funds immediately upon ONR’s request for such payment. All pending Sales Orders will be held for shipment and no future orders by You will be permitted until all outstanding Restocking and Market Loss fee balances have been paid in full. Original shipping, handling, and insurance charges are not refundable.

Returns and Market Gains

If the Fair Market Value of the Product(s) at the time of the Returned Sales Order is greater than the sales price of the Product(s) as it appears on the original Sales Order, as determined by ONR, then a Market Gain is said to occur and such gain will remain the sole property of ONR and ONR shall have no responsibility to You for the Market Gain. The Restocking fee may still apply in the event of a Market Gain.

c. Rare Coins, Paper Money, and Coin Supplies Sales

i. Rare Coins, Paper Money, and Coin Supplies Sales Order Adjustments

A Rare Coin, Paper Money, or Coin Supply Sales Order may, at the sole discretion of ONR, be adjusted before the order is shipped, which is generally no more than 1 business day from the order date. Once a Sales Order has shipped, it cannot be adjusted. All adjustment requests must be made by notifying our customer service by telephone at 1-844-667-2646. If the Sales Order can be adjusted, You will be given an updated Sales Order. Sales Orders for certain Precious Metals-related products listed under the “Rare Coins” section, including, but not limited to, “Pre-1933 Gold Coins,” cannot be adjusted. Please choose Your products carefully and review all details before submitting Your order.

ii. Rare Coins, Paper Money, and Coin Supplies Sales Order Cancellations

Cancellation Requests

Most Rare Coin and all Paper Money and Coin Supply Sales Orders can be cancelled without incurring a fee before the order is shipped, which is generally no more than 1 business day from the order date. Once a Sales Order has shipped, it cannot be cancelled. All cancellation requests must be made by notifying our customer service by telephone at 1-844-667-2646. If the Sales Order can be cancelled, You will be given a Sales Order Cancellation Number. No Sales Order without a Cancellation Number issued will be considered cancelled. Sales Orders for certain Precious Metals-related products listed under the “Rare Coins” section, including, but not limited to, “Pre-1933 Gold Coins,” will be subject to Cancellation fees and Market Loss fees, described below.

Cancellation and Market Loss Fees

Cancellation of a Sales Order for certain Precious Metals-related products listed under the "Rare Coins" section, including, but not limited to “Pre-1933 Gold Coins,” will be subject to Cancellation fees and Market Loss fees. You will be charged a $50 Cancellation Fee and ONR will have no liability to You for the product(s) included in Your Sales Order. In addition, if the Fair Market Value of the Product(s) at the time of the cancelled Sales Order is less than the original sales price of the Product(s) as it appears on the cancelled Sales Order, as determined by ONR, then a Market Loss is said to occur and You will be liable to ONR for the total Market Loss. You must also pay, and have full responsibility and liability to, ONR for all fees and costs associated with ONR’s efforts to collect from You. You also agree to remit payment in good funds immediately upon ONR’s request for such payment. All pending Sales Orders will be held for shipment and no future orders by You will be permitted until all outstanding Cancellation and Market Loss fee balances have been paid in full.

Cancellation and Market Gains

If the Fair Market Value of the Rare Coin and Paper Money Product(s) at the time of the cancelled Sales Order is greater than the sales price of the Product(s) as it appears on the original Sales Order, as determined by ONR, then a Market Gain is said to occur and such gain will remain the sole property of ONR and ONR shall have no responsibility to You for the Market Gain. For certain Precious Metals-related products listed under the "Rare Coins" section, including, but not limited to “Pre-1933 Gold Coins,” the cancellation fee will still apply in the event of a Market Gain.

iii. Rare Coins, Paper Money, and Coin Supplies Sales Order Returns

Return Requests

Once a Rare Coin or Paper Money Sales Order has been shipped, it cannot be cancelled. A Sales Order can be returned, however, within 15 business days of delivery to You. All return requests must be made within 15 business days of receiving Your Sales Order by notifying our customer service by telephone at 1-844-667-2646. If the Sales Order can be returned, You will receive written confirmation of the return, a Return Authorization Number, and instructions on how to return Your items. You must follow all instructions provided by customer service, including carefully packaging the product, and must ship Your return within 1 business day of receiving a return confirmation. You are responsible for the cost of return shipping and assume the risk of loss during the return shipment. ONR reserves the right to reject any return it receives in which our instructions have not been followed. No Sales order without a Return Authorization Number can be returned and ONR will refuse any return shipment received without a Return Authorization Number. After 15 days of receiving Your Sales Order, no products can be returned. However, if the products are needed by ONR, ONR may offer to purchase them based on current market conditions, which may be the same, less than, or greater than the price You paid for it.

Return and Market Loss Fees

Most Rare Coin and Paper Money products can be returned within the allowed time-frame without incurring any fees. However, return of a Sales Order for certain Precious Metals-related products listed under the "Rare Coins" section, including, but not limited to “Pre-1933 Gold Coins,” may be subject to Restocking fees and Market Loss fees. You may, at ONR’s discretion, be charged a restocking fee equal to $50 or 10% of the original Sales Order, whichever is greater. In addition, if the Fair Market Value of the Product(s) at the time of the Returned Sales Order is less than the original sales price of the Product(s) as it appears on the original Sales Order, as determined by ONR, then a Market Loss is said to occur and You will be liable to ONR for the total Market Loss. You must also pay, and have full responsibility and liability to, ONR for all fees and costs associated with ONR’s efforts to collect from You. You also agree to remit payment in good funds immediately upon ONR’s request for such payment. All pending Sales Orders will be held for shipment and no future orders by You will be permitted until all outstanding Restocking and Market Loss fee balances have been paid in full. Original shipping, handling, and insurance charges are not refundable.

Returns and Market Gains

If the Fair Market Value of the Product(s) at the time of the Returned Sales Order is greater than the sales price of the Product(s) as it appears on the original Sales Order, as determined by ONR, then a Market Gain is said to occur and such gain will remain the sole property of ONR and ONR shall have no responsibility to You for the Market Gain. For certain Precious Metals-related products listed under the "Rare Coins" section, including, but not limited to “Pre-1933 Gold Coins,” the Restocking Fee may still apply in the event of a Market Gain.

d. Sales Order Exchanges

We are deeply committed to Your satisfaction and work hard to provide You with quality products that are free of defects. We may, but are not obligated to do so, provide You with an opportunity to exchange Your product for an identical product in the event of certain material defects. Unique items for which our available quantity was only 1 at the time of Your purchase, cannot, understandably, be exchanged. All exchange requests must be made within 5 business days of receiving Your product by notifying our customer service by telephone at 1-844-667-2646. If the exchange request is approved, You will receive written confirmation of the exchange, an Exchange Authorization Number, and instructions on how to exchange Your items. You must follow all instructions provided by customer service, including carefully packaging the product. You are responsible for the cost of return shipping and assume the risk of loss during the return shipment as part of the exchange. ONR reserves the right to reject any exchange for any reason and to require You to pay for any Market Loss on approved exchanges. Any Market Gain on refunds will remain the sole property of ONR.

e. Condition of Returned and Exchanged Items

All products submitted for return or exchange must be in the same condition as when they were shipped to You. Certified coins and paper money must be in the original certification holder and free of damage or new contact marks or scratches on the holder. Uncertified coins and paper money must be housed in the original sealed ONR holder/package. All coin supplies and accessories must be in completely new, undamaged, and unopened condition. Any product that does not meet these requirements will be ineligible for return or exchange. If ONR receives any product from You for return or exchange that it believes is not in the same condition as when it was sent to You, ONR will refuse the product, ship it back to You, and refuse to issue a refund or provide an exchange.

f. Sales Order Payment Requirements

Payment for all Sales Orders must be dated within 24 hours of the Sales Order and received by ONR within 5 business days from the date the Sales Order is placed. If You default and payment is not timely received by ONR, ONR reserves the right to either accept Your late payment, refuse Your late payment and cancel Your Sales Order, close Your account, and/or prevent You from conducting future business with ONR. To ensure Your compliance with these terms, ONR recommends You submit Your payment on the same day as Your Sales Order, whether electronically, by mail, or bank wire. For payments sent by mail, we recommend choosing a priority delivery service that provides You with a tracking number to ensure timely delivery of Your payment with tracking capabilities. If You default and Your payment is not timely received by ONR and a Market Loss occurs, ONR may cancel Your order and You will be liable for any applicable Cancellation Fees and Market Loss Fees, as described elsewhere in this document for cancelled Sales Orders. Any Market Gain on such cancellations will remain the property of ONR.

All Sales Orders are reviewed on an order by order basis. ONR reserves the right to request additional documentation from You before processing Your Sales Order, including, but not limited to, proof of identity. ONR also reserves the right to refuse or cancel any Sales Order at any time and for any reason, including if it is deemed questionable or of significant risk to ONR, regardless of payment method and Sales Order value. If ONR refuses or cancels Your Sales Order, You waive any right to any claim or actual damages incurred by such cancellation whatsoever.

g. Sales Order Payment Methods

Various payment methods are accepted for Sales Orders, depending on their total value. For online and in-person Sales Orders valued under $5,000.00, Credit Card, PayPal, Personal Check, eCheck, and Cashier’s Check payments are accepted. For online and in-person Sales Orders valued from $5,000.00 to $49,999.99, payment can be made by all the above, as well as by Bank Wire. For online and in-person Sales Orders valued at $50,000.00 and above, generally only Bank Wire will be accepted. For certain in-person transactions involving clients with a well-established financial history, ONR may accept other forms of payment at our sole discretion. In addition, certain smaller Sales Orders picked up in person can be paid for in cash. For online Sales Orders, Cash on Delivery (C.O.D.) cannot be accepted.

Cash and Cash Equivalent Payments

Two price tiers are displayed on the ONR Website for certain products: “Cash/Check” price and “Credit Card/ PayPal” (CC/PayPal) price. The CC/PayPal price represents the full list price, while the Cash/Check price represents a 3.00% discount applied to all Sales Order paid for by cash, personal check. eCheck, cashier’s check, and bank wire (for Sales Orders of at least $5,000.00).

Check Payments

ONR will deposit all forms of check payments before shipping Your Sales Order. Shipment will generally occur 5-10 business days following the date of deposit, even if the check clears normal banking channels sooner. In no situation will expedited processing of Your Sales Order occur prior to clearance of Your check payment. Additional delays may occur if Your bank does not cooperate with our request to verify Your transaction.

Bank Wires

If You choose to pay for Your Sales Order by bank wire, we will provide You with instructions on how to complete Your wire transfer, including our bank name, routing number, and account number after Your order is placed. Shipment will generally occur within 1 business day following receipt of Your good funds.

Credit Cards

We may accept credit card payments for Sales Orders but are not obligated to do so. We will only ship to the billing address of the credit card used for payment. Please ensure Your shipping address matches the billing address in Your online account before placing a credit card Sales Order. Credit Cards are not accepted for international Sales Orders. ONR reserves the right to refuse any credit card payment for any reason.

ACH Payments

ONR does not accept ACH payments for online Sales Orders. We do accept online eChecks, which are treated like a personal check for processing and shipping purposes.

Currencies

We only accept payments in United States Dollars (USD).

h. Shipping and Insurance

ONR may ship Your product(s) by any carrier, including, without limitation, United States Postal Service (USPS), United Parcel Service (UPS), and FedEx, and may require carrier confirmation of delivery to You and/or the signature of You or Your authorized agent. Shipping is free for Sales Orders of at least $100.00 and $4.95 for Sales Orders under $100.00. All Sales Orders are fully insured by ONR, our insurance provider, and/or the shipping carrier for the amount listed on the Sales Order while in transit to You. Orders sent by USPS Registered and Insured mail may take an average of 5-10 business days after leaving our facility to be delivered.

i. Lost and Stolen Shipments

Should Your product(s) be lost or stolen prior to delivery to You, ONR will either replace Your product(s) or issue You a refund at our discretion, subject to the following limitations: ONR must be notified of a lost or stolen package within thirty days of Your ship date. If You do not notify us within this time frame, we specifically disclaim liability for Your lost or stolen Sales Order. ONR shall have no liability to You for Sales Orders that are lost or stolen after carrier confirmation of delivery to You and/or the signature of You or Your authorized agent has been obtained. In no circumstance will ONR or our insurance company be liable to You if You instruct any carrier or delivery service to leave shipments for You without the need for Your signature. Further, ONR shall have no liability to You if You instruct any carrier or delivery service to leave Your package with anyone else, including a neighbor, building representative, or third-party drop-off location such as The UPS Store, Mail Boxes Etc., or other venue. If You do not receive Your package due to loss or theft, You agree to take all reasonable actions to assist ONR in recovery of the package, including, but not limited to, filing reports, such as police reports, and providing ONR with any information needed to assist in recovering the package. If You do not cooperate fully with such recovery efforts, neither ONR nor our insurance company will have any liability to You.

j. Damaged Shipments

Should You receive Your product(s) in damaged condition, You must notify ONR of such damage within one business day following the carrier confirmed delivery and must ship the damaged product(s) and all original packaging back to ONR for replacement or full refund. ONR will reimburse You for Your return shipping expenses in this specific circumstance. In no circumstance will ONR be required to grant full or partial refunds for damages that occur during shipping while also allowing You to retain the damaged product(s).

k. Back Orders

In some instances, ONR may be unable to ship Your order immediately due to a temporary lack of product availability. If this should happen, ONR reserves the right to place Your order on back order and delay delivery of Your Sales Order up to 28 calendar days from Your expected shipping date and You shall have no right to cancel Your order without penalty. If You do choose to cancel Your order, any applicable Sales Order cancellation fees and Market Loss fees will apply. If we are unable to ship Your Sales Order within 28 calendar days, You may request a refund or choose to wait longer for Your product. If items are shipped to You after a delay or if a refund is provided due to a lack of product availability, You waive all rights to any claim or actual damages whatsoever.

l. International Orders

All international orders must be shipped to a physical address and a delivery zone surcharge may apply. We generally do not accept Sales Orders shipped to international addresses using freight forwarding services, such as Vpost addresses. If Sales Orders are placed online and shipped to such addresses, including if ONR is unaware that such address is not Your personal address, all risk of loss is Your liability once ONR delivers Your Sales Order to Your designated freight forwarding service address.

For Sales Orders shipped outside of the United States, You are solely responsible for any duties or taxes imposed by Your country. ONR will always declare the full value of Your Sales Order for customs purposes, without exception. Please consult Your customs broker for more information on duties and taxes.

If Your Sales Order is returned to ONR due to the inability of the carrier to deliver it to You or Your refusal to pay duties or taxes, You shall be responsible for any return shipping fees, additional duties, or applicable taxes incurred while returning the package to ONR. If Your Sales Order is in fact returned to us, we will not reship Your Sales Order unless we are paid in full for any return shipping costs, duties, and taxes we may have paid on Your behalf, as well as any expenses incurred while re-shipping the Sales Order back to You. If You choose not to allow the Sales Order to be reshipped to You, You are still liable for any additional expenses, duties, and taxes incurred by us, as well as any fees incurred by our attempt to collect from You. International returns on Sales orders are very costly and we strongly recommend You take appropriate measures to ensure Your taxes and duties are paid and Your order is deliverable.

7. Selling to ONR

a. Determining Purchase Offers

For some products, including most Precious Metals products, ONR can establish a sight-unseen Purchase Offer based on Your accurate description of the type, quality, and quantity of items You wish to sell and generate a Purchase Order Confirmation Number. For many Rare Coin and Paper Money products, however, You must first ship or deliver Your product(s) to ONR for expert appraisal before we can generate an offer. We will confirm receipt of such product(s) electronically when they enter our physical custody. ONR will then expertly appraise Your products and provide a Purchase Offer to You electronically within ten business days of receiving Your products. You must either accept or decline such Purchase Offer within 1 business day. For Precious Metals-related products, our offer may change continuously based on market conditions and will be quoted in relation to the metal market price, which is subject to change at any time and without notice. If You chose to accept our Purchase Offer, a Purchase Order Confirmation Number will be generated, and You cannot cancel the Purchase Order without penalty. If You decline our Purchase Offer, we will securely ship Your product(s) back to You with a declared insurance value equal to our Purchase Offer price. You will be responsible for the cost of return shipping and Your products will not be shipped back to You until we have received good payment for return shipping and insurance charges. If You fail to either accept or decline our Purchase Offer within 1 business day of Your receipt of the same, then You will be considered to have accepted ONR’s offer by default and a confirmed Purchase Order will be established for You and cannot be canceled without penalty.

b. ONR Offer Prices

ONR makes every effort to pay competitive prices for the Rare Coin, Paper Money, and Precious Metals products it purchases that are consistent with the range of prices typically paid for such products in the Rare Coin, Paper Money, and Precious Metals industry. However, ONR offer no warranty and makes no guarantee that it will pay average or above average prices for such products, and You agree not to seek from ONR additional payments or damages should You later determine that higher prices could have been obtained elsewhere. You acknowledge that it is in Your best interest to consider multiple offers for Your products before selling to ONR and that ONR cannot be responsible for Your decision to sell to ONR without consideration of such alternative offers.

c. Minimum and Maximum Transaction Values

Items sold to ONR can either be shipped to ONR or delivered in person to the ONR physical store or a trade show or other buying event we are attending. When selling to ONR in person, there is no minimum or maximum Purchase Order value. When shipping products to us, there is a $500 minimum Purchase Order requirement and no maximum value.

d. Purchase Order Confirmation

Depending on the type of product(s) You are selling to ONR, ONR may either determine our purchase offer prior to, or following, Your shipment or delivery of product(s) to ONR. When ONR determines our Purchase Offer prior to Your shipment or delivery, our Purchase Offer is confirmed with a Purchase Order Confirmation Number, the price for the product(s) included in Your Purchase Order is established, and the order cannot be cancelled without penalty.

e. Purchase Order Cancellations

i. Cancellation Requests

Once a Purchase Order confirmation has been issued, the price is locked-in and You are contractually bound to complete the transaction, or You will pay a fee for breaching this contract. All cancellation requests must be made by notifying our customer service by telephone at 1-844-667-2646. If the Purchase Order can be cancelled, You will be given a Purchase Order Cancellation Number. No Purchase order without a Cancellation Number issued will be considered cancelled.

ii. Cancellation and Market Loss Fees

Cancellation of any Purchase Order by You will result in a $50 Cancellation Fee. In addition, for any product listed under the "Gold," "Silver," "Platinum," and "Palladium" sections of the ONR Website (“Precious Metals”), as well as certain Precious Metals-related products listed under the "Rare Coins" section, including, but not limited to “Pre-1933 Gold Coins,” a Purchase Order cancellation will be subject to Market Loss fees. If the Fair Market Value of the Product(s) at the time of the cancelled Purchase Order is more than the original purchase price of the Product(s) as it appears on the cancelled Purchase Order, as determined by ONR, then a Market Loss to ONR is said to occur and You will be liable to ONR for the total Market Loss. You must also pay, and have full responsibility and liability to, ONR for all fees and costs associated with ONR’s efforts to collect from You. You also agree to remit payment in good funds immediately upon ONR’s request for such payment. Any pending Sales Orders will be held for shipment and no future orders by You will be permitted until all outstanding Cancellation and Market Loss fee balances have been paid in full.

iii. Cancellation and Market Gains

If the Fair Market Value of the Product(s) at the time of the cancelled Purchase Order is lower than the purchase price of the Product(s) as it appears on the original Purchase Order, as determined by ONR, then a Market Gain in favor of ONR is said to occur and such gain will remain the sole property of ONR and ONR shall have no responsibility to You for our Market Gain, which manifests as a Market Loss to You. The cancellation fee will still apply in the event a Market Gain to ONR occurs as a result of Your Purchase Order cancellation.

f. Purchase Order Fees

When You sell to ONR, there are no Purchase Order fees. You are responsible for Your own shipping and insurance, but we will pay You the amount we agreed upon, provided we receive the product(s) agreed upon.

g. Payments for Purchase Orders

ONR will generally issue payment for Purchase Orders within 5 business days of receiving Your order, whether by shipment or personal delivery, provided we have received the correct type, quality, and quantity of products included in Your Purchase Order. Errors or omissions on Your part may delay the payment process. You can select to be paid by either a business check sent via first class mail or Bank Wire (subject to a $25 processing fee).

8. Shipping to ONR

a. Shipment Confirmation

Once Your Purchase Order is confirmed, You are obligated to send the agreed upon type, quality, and quantity of product(s) to ONR. In addition, You must send us the carrier-issued tracking number within 1 business day of Your Purchase Order and must ensure we receive Your shipment within 5 business days of Your Purchase Order. If ONR does not receive the accurate type, quality, and quantity of products ordered, or if we do not receive Your tracking number or shipment in a timely fashion, ONR reserves the right to cancel Your Purchase Order and/or subject You to fees, including Cancellation and Market Loss fees described above. ONR may also prohibit You from buying from us or selling to us in the future. If You do provide us with the tracking number within 1 business day as required, and we do not receive Your Purchase Order within 5 business due to a delay caused by the shipping service, we may extend the deadline on a case-by case basis, but are not obligated to do so.

b. Shipping and Insurance Methods

When You ship to ONR for any reason, You are required to do so by USPS First Class Mail, Priority Mail, Express Mail, and/or Registered Mail, with USPS insurance to cover Your shipment value. All packages must be shipped to “ONR, PO Box 19816, Pittsburgh, PA 15213.” ONR will provide You with instructions and advice on how to package and ship Your products securely. Such information is also available by calling customer service at 1-844-667-2646. All shipments must be in plain packaging with no words on the outside that relate to coins, paper money, precious metals, numismatics, numismatic rarities, or any other words or phrases that may indicate valuable package contents. To reiterate, all packages must be addressed simply to “ONR,” not “Olevian Numismatic Rarities” or other company name or abbreviation potentially suggestive of value. Any packages sent to any other address than the one above, including other addresses affiliated with ONR, will not be accepted and will returned to You by the carrier.

When shipping product(s) to ONR for which a Confirmed Purchase Order price has already been established, the USPS insured value must be equal to the Purchase Order amount. When shipping product(s) to ONR for which a Confirmed Purchase Order price has not already been established, the USPS insured value must be determined by You and must be an estimate of the total value of the product(s) You are shipping to ONR. ONR can assist You in determining an appropriate estimated value of Your product(s) prior to shipment based on a detailed description by You of Your product(s), but ONR makes no warranty and does not guarantee that it will offer to pay You Your declared insurance value for Your product(s), should You decide to sell to ONR, and in fact may offer You less than, the same as, or more than the declared insurance value, pending receipt and expert appraisal of Your product(s) with regards to current market conditions. Your declared insurance value is strictly for the purposes of mitigating Your personal risk of loss during shipment.

c. Shipping Risks

You are responsible for all risk of loss associated with shipping or delivering Your Purchase Order, Return, or other package to ONR until we take physical custody of each product contained in Your shipment. Furthermore, if Your product(s) are lost, stolen, or damaged during shipment to ONR, You acknowledge that ONR is not liable to You for any payment or damages and that any claim for payment or damages must be made by You to USPS. You also acknowledge that, while ONR will attempt to provide You, within reason, information needed to file Your claim with USPS to obtain reimbursement from USPS for Your lost, stolen, or damaged product(s), ONR is not required to do so, and ONR makes no warranty or guarantee that You will be able to recover such damages from USPS.

In situations for which You ship Your product(s) to ONR before we establish our purchase offer, and You decide not to accept such offer, ONR will return Your product(s) to You by USPS with a declared insurance value exactly equal to the ONR offer price. ONR shall be liable to You for this declared insurance value, should Your product(s) be lost, stolen, or damaged prior to confirmed delivery to You by USPS, provided that USPS or another insurance company makes full payment to ONR for any claim ONR places against USPS for Your insured product(s) that are shipped to You. If USPS does not make full payment to ONR for the value of Your product(s) declared by ONR for any reason, then ONR shall only be liable to You for the total amount, if any, paid to ONR by USPS for Your lost, stolen, or damaged product(s). Such liability shall be payable to You by ONR within thirty (30) business days following ONR’s receipt of such payment from USPS.

9. Appraisals

a. Appraisal Services

ONR offers appraisal services for rare coins, paper money, precious metals, and other elements of numismatic antiquity based upon our own unique professional experience in this industry. For a fee, ONR prepares Appraisal Reports summarizing our collective professional opinions in this area. The data contained in an Appraisal Report are just that, our opinions, and may or may not reflect the opinions of other numismatic professionals. The products described in an Appraisal Report are appraised based on a multitude of numismatic price guides and precious metals market prices that are current at the time of appraisal. However, rare coin and precious metals prices can fluctuate daily—and occasionally substantially, over longer periods of time. Consequently, it is prudent to acquire updated appraisals at least yearly for rare coins, and more frequently for precious metals, depending on the level of accuracy You wish to maintain for Your records.

b. Appraisal Values

The appraised values listed in an Appraisal Report represent fair and ordinary prices that individuals can expect to pay for similar products based on market analysis, and thus reflect full replacement values. However, some products may be very scarce or even unique, and, therefore, ONR makes no guarantee that the appraised products can ever be replaced with similar products for the prices listed in an Appraisal Report. Likewise, the value of a product is ultimately determined by what someone is willing to pay for it, and thus ONR makes no guarantee that the products listed in an Appraisal Report can ever be sold for the appraised values.

Under no circumstance does an appraisal provided by ONR constitute a contract that ONR will purchase Your products, should You decide to sell them. However, if You decide to sell Your products and ONR offers to purchase them, You acknowledge that the appraised values do not necessarily reflect prices that ONR will pay for Your products. Instead, ONR will make an offer that is commensurate with current market conditions,
